"DNR" is an interesting
and highly anticipated book authored by Maurice Mehrban
in a medically familiar language to tackle legal issues
and hardship of Medical Professionals at large. The term
"DNR" stands for Doctors Need Retribution" with subtle

Nuance of month...
IF YOU ARE IN THE FIELD OF
MEDICINE AND YOU WANT TO GET DIVORCE, YOU NEED A MEDICALLY
ORIENTED ATTORNEY
You know the difficulty of
being a Medical Provider recently. You have to confront
insurance companies, hospital administrative, legislative, and
even the patients and patients’ family. At the same time your
own family does not understand the situation and you must
maintain the status of an entrepreneur. The ugliest scenario
might happen when your spouse decides to divorce you. You may
face the worst humiliation in family court at the time of
dissolution of marriage. In one case, the surgeon had to
remain in prison for two weeks since he could not find his
account number in Switzerland. In
other case, the internist was imprisoned since he violated a
court order. Courts are still under the impression that
Medical Providers are resourceful and money making machines
and the court ordered child supports are outrageous and
unbearable under current medical economical situation. In one
case, a court ordered Dr. Beatrice C., to pay $30,000 in
monthly support to the previous marital partner. Interesting
enough, the investigation and discovery showed that the spouse
was cashing the insurance company payment checks, and hiding
income. Moreover, the vocational evaluation showed that the
demanding spouse had capability to make about $9,000 a month.
Further, medically oriented lawyer hired medical economists,
forensic accountants, and health business management companies
to provide the court with ample evidence to reduce the monthly
support considerably lower than previously ordered one.
DO NOT LET
LEGAL FEES DESUADE YOU FROM PURSUT OF YOUR CASE
A young
Physician came to our office few months ago since he received
a letter from Medical Board about a DUI and they demanded an
appearance to show cause “why his license may not be
mitigated”. We had a lengthy conversation when we discussed
all legal variables and angles of the case. This discussion
was without charge and the good doctor was informed about the
legal fees and probable future fees engaged in resolution of
the matter, such as discovery fees and experts.
As is
reasonable and customary, the good doctor opted shopping
around for further advisement and fee searching.
Unfortunately, he was misled to believe that the issue would
be resolved in 2 to 3 months with a minimal fee and a retainer
of $10,000 was secured by a non-medical legal firm. We
received a call from this good friend ten (10) months later
when he advanced considerable amount of money [over 75,000]
and the law firm did not engage in proper process of
litigation. Our suggested fee, although high, but was not far
from truth. This gullible medical provider was in a very
precarious situation and the wrong done could be corrected but
with more expense and hardship.
Please note,
when you have a legal dilemma you must ask all relevant
questions, the procedures involved, the possible extent of
legal fees, and all variables. No lawyer can promise you
success and minimal fees. Honesty and ethics is cornerstone of
professional practice of Medicine and Law.
Majority of
Medical provider Legal issues are medically oriented, requires
medically knowledgeable legal experts, and is “expensive”.
Nevertheless, your medical or nursing license is your
livelihood.
Please search
all angles of your case, ask about procedures and
complications and involved fees. Do not endanger your case by
a false promise of lower fees. Medical professional cases are
complex, difficult, lengthy, and expensive. You must know that
no lawyer could promise or warranty success; that is, you may
spend thousands of dollars and yet lose your license.
DO NOT VENTURE
PRACTICING LAW YOURSELF
It is very important to
leave professional work to professionals.
A medical care provider
has ample task performing her(his) own medical work and there
is no need for a medical professional to take care of her own
legal issues. We go even further and state that, a medical
care provider ought to consult a medically oriented law firm
for majority of business and professional ventures. We are
physicians and lawyers, and we used to practice medicine
before we entertained our law degrees and we remember our
daily anxieties and complications when we wanted to take
step toward non-medical issues. Simple example is when a
physicians intends to start or terminate the medical practice,
buy or sell his office, start or advance new ventures of
practice or billing, sign contracts or to incorporate, get
married or cohabit, buy or sell real properties or
intellectual properties, change the medical malpractice plan,
advance billing, etc. I want to reiterate that you are not
able to take care of your medical malpractice problems,
medical board issues, or calls and contacts by insurance
investigators, and Medicare or FBI agents while you are
practicing medicine.
Unfortunately quite
often, our Law Firm is retained by a medical provider when
some haphazard legal work is already done by the physician;
this makes our job close to impossible and your legal expenses
much more, if we opt to engage at all. Physicians believe that
friendly responses by Insurance Company investigators, FBI
agents, and Medical Board investigators is to assist them
and thus they communicate or relay information to these
bodies that is sometimes most detrimental to them
when we try to resolve the issues. Most detrimental is
when a physician tries to resolve a medical malpractice issue
by communication with plaintiffs, or plaintiff attorneys;
the worst is trying to pay off or silence these cases without
legal consultation.
Do not forget that the
legal issues are not handled like medical problems, they are
not black and white and they are open to possibility of
manipulation and contamination by opposing party if proper
legal discovery and investigation is malhandled or
delayed.
Do not contact the
patient when you receive a 90 Days Notice of pending
litigation. We recommend that you speak with a medically
oriented law firm like our office to give them an opportunity
to resolve the issue professionally before you pick up the
phone and call the patient or contact your Med-Mal Insurance
agent. In majority of cases, your simple call to malpractice
company is harbinger of the increase in your primiums although
malpractice insurance company may never get involved or
hire a law firm until the lawsuit is filed. We represent
physicians in medical Malpractice lawsuits and we have been
able to abort some lawsuits in early stages before the
lawsuit was filed.
Do not speak with
Medical Board agents and do not let them come to your
office to interview you without prior consultation with your
lawyer. Understand that Medical Board is not physicians'
friend, they are there to discipline you, and no matter how
busy you are, do not let them come to your office until you
talk to an expert medical lawyer. Do not speak with agents of
City Attorney's office, District Attorney's office, Insurance
Company agents, Police and FBI until you discuss the matter
with the medically oriented lawyer; let them make the call and
discover the extent of complication without making damaging
remarks. Realize that medical law is best handled by
medically oriented lawyer and a big law firm without medical
orientation, no matter how experienced they are as a matter of
law, may not be able to resolve a medico-legal issue that is
known and understood by a doctor. In may cases, these law
firms have to pay considerable amount of your money to doctors
to advise the lawyer about CPT codes, medical diagnoses,
differential diagnoses, prognosis, treatment plans, ICU and
CCU procedures, indications and contra-indication of
medications, pathophysiology of diseases, and specially review
of progress notes and order sheets, nursing staff notes,
nutrition and physical therapy, and procedure notes. This is
when we, as double or triple board certified practicing
physicians and lawyers come as paramount
masters.
